Terms of Service

1. Acceptance of Terms

By accessing or using the Velvet platform ("Service"), operated by House of Velvet, Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Velvet is an AI-powered adult-entertainment platform that provides interactive conversations and content featuring AI-generated fictional characters. The Service may include sexually explicit or suggestive material and is intended for adults only.

3. Age Restriction

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use Velvet. By using the Service, you represent and warrant that you meet this requirement. We do not knowingly collect or store information from anyone under 18.

4. User Accounts

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Notify us immediately of any unauthorized access or breach.

5. Prohibited Uses

You agree not to use the Service:

• For any unlawful or prohibited purpose.
• To infringe on any intellectual-property or privacy right.
• To upload, create, or distribute content involving minors, non-consensual acts, incest, bestiality, or any other illegal or obscene material.
• To depict or upload real individuals without their express consent.
• To engage in harassment, threats, or exploitation of any person.
• To encourage or promote self-harm, suicide, or violence toward yourself or others.
• To use Velvet as a substitute for emotional support, therapy, or counseling.
• To upload malware or malicious code.

We reserve the right to monitor, remove, or restrict any content that violates these Terms or applicable law.

6. AI Content and Fictional Nature

All characters, dialogue, and scenarios generated within Velvet are fictional simulations created by artificial-intelligence models. Interactions may simulate romance or intimacy for fantasy and entertainment purposes only. They do not represent real persons or relationships. By continuing, you acknowledge that all experiences are virtual, fictional, and self-directed.

7. Adult Content and Compliance

Velvet prohibits all illegal or non-consensual sexual content. You may not use the Service to produce or distribute obscene or unlawful material under 18 U.S.C. § 1466A or related statutes. If you create or upload any adult media using real individuals, you are solely responsible for compliance with 18 U.S.C. § 2257 record-keeping and consent documentation requirements. We may remove or report material that appears to violate these standards.

8. Mental Health and Safety Disclaimer

Velvet is not a therapist, counselor, or medical provider. The Service does not diagnose, treat, or provide advice regarding mental health, relationships, or wellbeing. If you experience emotional distress, loneliness, or thoughts of self-harm, do not rely on Velvet. Please contact the 988 Suicide and Crisis Lifeline (US) or local emergency services. We may restrict or suspend use if we believe a user's safety is at risk or if conversations indicate potential harm.

9. Privacy and Data

Your privacy is important to us. We store data securely using Supabase infrastructure and follow best practices for encryption and limited retention. Please review our Privacy Policy for details on how we collect, use, and protect your data.

10. Intellectual Property

All original content, trademarks, graphics, and software remain the exclusive property of House of Velvet, Inc. and its licensors. You may not copy, reproduce, or redistribute any part of the Service without prior written consent.

11. Termination

We may suspend or terminate your account at any time, without notice, if you violate these Terms or engage in unsafe, illegal, or abusive conduct.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no representations or warranties, express or implied, regarding accuracy, reliability, or suitability for any purpose. You use Velvet at your own discretion and risk.

13. Limitation of Liability

To the fullest extent permitted by law, House of Velvet, Inc. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service, including emotional or psychological harm.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.

15. Changes to Terms

We may update or modify these Terms at any time. If changes are material, we will provide reasonable notice (for example, by posting on the Service or emailing registered users). Your continued use constitutes acceptance of any updated Terms.

16. Apple App Store Terms

If you access Velvet through the Apple App Store, your use of the app is subject to Apple's Standard End User License Agreement (EULA) available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. The following additional terms apply:

• Acknowledgement: You acknowledge that this agreement is between you and House of Velvet, Inc. only, and not with Apple. House of Velvet, Inc., not Apple, is solely responsible for Velvet and its content. This agreement may not conflict with the Apple Media Services Terms and Conditions.
• Scope of License: The license granted to you is limited to a non-transferable license to use Velvet on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. Velvet may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and Support: House of Velvet, Inc. is solely responsible for providing any maintenance and support services for Velvet. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Velvet.
• Warranty: House of Velvet, Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Velvet to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Velvet. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Velvet.
• Product Claims: You acknowledge that House of Velvet, Inc., not Apple, is responsible for addressing any claims relating to Velvet or your possession and use of Velvet, including but not limited to: (i) product liability claims; (ii) any claim that Velvet fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual Property Rights: In the event of any third-party claim that Velvet or your possession and use of Velvet infringes that third party's intellectual property rights, House of Velvet, Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Terms: You must comply with applicable third-party terms of agreement when using Velvet, including your wireless data service agreement.
• Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this agreement, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.

17. Developer Terms and Prohibited Content

Your use of Velvet is also subject to these Terms, which govern access to the service, rules for acceptable content generation, and the rights and responsibilities of users. Velvet does not host user-generated content — all outputs are generated by our AI models. You agree not to use the service to attempt to generate content that is illegal, abusive, exploitative, or otherwise prohibited. Violation of these terms may result in termination of your access.
